Should the Commission decide on “intervention as a precautionary measure,” the Municipal Government Secretariat, led by Arnulfo Guerrero León, will be authorized to oversee the organization of the festival. Aguirre emphasized that this authorization allows the Secretariat to carry out the celebration independently or through a third party, ensuring independence festivities take place annually.

Alderman Arturo Aguirre remarked during a council meeting that the Museo Interactivo Tijuana A.C. failed to submit timely operational manuals needed to guarantee the safety of festival attendees. He noted that the association is significantly indebted, particularly concerning the use of Morelos Park, and had not adhered to the requirements despite multiple notifications.

Additionally, financial obligations to the Municipal System of Thematic Parks of Tijuana (Simpatt) for facilities such as the main event hall and parking lot remain unresolved.

The council’s decision, made at a session on March 28, marks the start of the revocation process, highlighting continuous non-compliance from the association despite having its concession extended in 2018 for a decade.
