### Over the Last Five Years, Tijuana General Hospital Staff Faces 36 Complaints

In the last five years, the Tijuana General Hospital (HGT) has seen 36 complaints and grievances filed against its staff. These allegations range from workplace harassment, medical negligence, poor service, harassment, and other causes. According to data obtained through the National Transparency Platform (PNT), 17 of these complaints were resolved without sanction, 12 remain active, two were preventive, one resulted in a sanction and is currently undergoing administrative tribunal proceedings, one is in process, and three were deemed outside of the institution’s jurisdiction and referred to other agencies.

One notable case involves Amapola García Bernal, a general medical practitioner in her third year as a surgical resident. García Bernal, who graduated from the Universidad Autónoma de Baja California (UABC) and completed her internship and social service at HGT between 2016 and 2018, was dismissed following an investigation she claims was biased. García Bernal returned to HGT to work during the COVID-19 pandemic before starting her surgical specialty in 2021.

In July 2022, she reported a verbal and physical assault counterattack by a physician in the emergency service to the Department of Teaching and Human Resources. Although an investigation followed, and despite García Bernal and her witnesses giving their accounts, the accused doctor did not show up. The case concluded with allegations against García Bernal for attempting to tarnish the doctor’s impeccable reputation, which she denies.

Post-incident, multiple harassment complaints were leveled against García Bernal herself, leading to her expulsion from HGT in January 2024 after several months and a committee evaluation. García Bernal claims she wasn’t given a chance to defend herself or explain her situation before the committee. Subsequently, she was reassigned to the General Hospital of Playas de Rosarito but was formally discharged from Isesalud and the educational program in February 2024.

The Baja California Health Secretariat revealed that federal inspections by the Directorate General of Quality and Health Education (DGCES) led to García Bernal’s dismissal due to her repeated conduct violations. Despite efforts from the state health secretary to support her, the DGCES upheld the decision.

García Bernal, who was in her final year of residency, has filed a human rights complaint for the violation of her right to education with the State Human Rights Commission (CEDHBC). She’s also pursuing a labor lawsuit against Isesalud and UABC to finish her medical specialty. Despite being unable to re-enter the surgical program or take another residency exam, García Bernal emphasizes her need to return to her studies and complete her surgical training.
