### Regional Court Rejects Injunctions Against Tijuana City Council Members

The Guadalajara Regional Chamber recently dismissed the precautionary measures issued by the Electoral Tribunal of Baja California against Tijuana city council members who missed six council sessions in July 2024.

The Tribunal’s agreement stemmed from a citizens’ lawsuit filed by Mayor Montserrat Caballero Ramírez, citing potential acts of Gender-Based Political Violence against Women. The mayor argued that the absences of the council members were obstructing her position as the municipal president of Tijuana on equal terms.

The Tribunal’s measures were intended to compel the council members to “take necessary steps to hold the mentioned sessions,” the Regional Chamber summarized. Additionally, the local court ordered a re-channeling to the Contentious Electoral Unit of the Baja California State Electoral Institute to examine the alleged acts.

In response, the council members filed two lawsuits with the Federal Judicial Electoral Tribunal, which were assigned to Judge Sergio Arturo Guerrero Olvera from the Guadalajara Regional Chamber.

One of the lawsuits, filed to protect the political-electoral rights of citizens, was brought by council members Alejandro Cabrera Acosta, Mónica Lucero Vázquez Arévalo, Édgar Montiel Velázquez, Marisol Hernández Sotelo, Miriam Patricia Echeverría Gastélum, Erwin José Areizaga Uribe, Juan Carlos Hank Krauss, and Claudia Casas Valdez. Juan Carlos Hank Krauss also filed a separate lawsuit.

Mayor Caballero Ramírez, acting as a third interested party, described the council members’ arguments as “frivolous,” characterizing them as “generic, vague, and imprecise statements” that failed to refute the Tribunal’s basis for issuing the precautionary measures. She further argued that the council members had no “legal interest to participate in the citizens’ lawsuit” since their council positions did not grant them the right to unjustifiably miss sessions.

The Regional Chamber, however, concluded that the council members did present valid arguments. The Chamber also found no merit in the claim that they lacked legal standing, reinforcing that it is sufficient for the complainant to assert a substantive right and demonstrate the need for judicial intervention to rectify the perceived violation.

The Guadalajara Regional Chamber emphasized that the local Tribunal’s agreement “impacted their right to effectively perform their duties.” Consequently, on September 12, 2024, the Chamber resolved in favor of the council members, revoking the disputed agreement concerning the precautionary measures.

Council member Édgar Montiel Velázquez mentioned that despite the ruling, the Tijuana city council still needs to convene to declare the solemn session for incoming Mayor Ismael Burgueño Ruiz, set to take office on October 1. He expressed doubt that Mayor Caballero would call the session, suggesting she might avoid it out of spite.

He attributed the absences to the sessions being scheduled as extraordinary with little advance notice.
