On Monday, August 5, José de Jesús Damián Vadial was formally charged in connection with the possession of firearms exclusive to the military. Vadial is a suspect in the murder of Tijuana Tourist Police Chief Justo Gutiérrez de la Torre, which occurred on the night of July 27 in the Quinta Marsella neighborhood.

Authorities linked Vadial to the crime based on the discovery of four long-barreled firearms—two .223 caliber and two .72 caliber—found in his taxi. These weapons have been connected to other criminal activities as well.

For instance, a .223 caliber firearm discovered in Vadial’s possession was previously used in a fatal shooting on March 5, 2022, in Tijuana’s Guaycura neighborhood. Another weapon, caliber unspecified, was connected to the murders of two individuals on February 5, 2021, in Tecate. Both cases remain under investigation.

Additionally, four ballistic vests marked with the initials F.E.R. were discovered. During a hearing, it was revealed that these vests likely belong to the “Fuerzas Especiales del Ranchero,” a criminal group operating under the Sinaloa Cartel (CDS).

A police report detailed the events leading to Vadial’s arrest. Following the assassination of Gutiérrez de la Torre, a security operation led authorities to the Tejamen neighborhood, where they located Vadial’s taxi. Inside the vehicle, police found the aforementioned weapons, ballistic vests, and alcoholic beverages. These discoveries prompted District Judge Fausto Rolando González Urzais to remand Vadial into custody, setting a two-month limit for additional investigation, due October 7.

During a separate hearing, Vadial claimed that on July 28, following his brother’s birthday party, he was detained unjustly by municipal officers. His partner, Perla Lizeth López Valdés, and neighbors, Karla Julieta Valenzuela Sánchez and Ernesto Rubio Hernández, witnessed the event. However, their accounts differed regarding the number of patrol cars present, leading the Federal Public Ministry (FGR) to challenge the credibility of their testimonies. As a result, the judge proceeded with Vadial’s trial for the unlawful possession of military firearms.
