Rosarito Pioneers Mortgage Trials

The introduction of oral trials in mortgage matters marks a significant step in legal reform in Playas de Rosarito. However, concerns have been raised regarding potential risks associated with recent judicial reforms in Baja California. Stay informed on TJGringo.com for updates.

### Playas de Rosarito to Pioneer Mortgage Oral Trials

Playas de Rosarito is set to become the first municipality in Baja California to implement oral trials in mortgage matters. This initiative, spearheaded by Alexander Bazán Gómez Llanos, the President of the Bar Association of Tijuana, is designed to streamline the property regularization and testamentary succession processes for local citizens.

According to Bazán Gómez Llanos, smaller cities have been chosen for the initial rollout to easily address any procedural adjustments before expanding the program to larger urban areas. The Baja California Judicial Authority has provided extensive support and information for this project, including the construction of a dedicated facility. The mandated oral trial system will officially take effect across the entire state of Baja California by 2027.

Additionally, Rosarito will soon see the launch of the “Colmena Courts” in October. These courts will operate with four primary judges focused solely on case resolutions, bypassing administrative duties. Situated on the third and fourth floors of the World Trade Center in Tijuana, these courts will allow citizens to electronically file complaints and access computer centers to monitor the progress of their cases. The Colmena Courts aim to increase efficiency by handling up to four times as many cases with the same personnel.

Both the oral trials and the Colmena Courts will enable the community to manage issues like property regularization, testamentary succession, claims of invaded properties, and rental contract disputes. By offering electronic filing services and consultation resources, these courts represent a significant step toward modernizing the judicial process in Baja California.

### Judicial Reform Concerns

The Bar Association of Tijuana has raised alarms regarding the potential risks associated with recent judicial reforms. These reforms could compromise the justice system and the separation of powers, according to legal experts.

Baja California’s judicial entities are preparing for substantial changes, including the introduction of oral trials and specialized courts. However, 160 judges and magistrates will reportedly be impacted by the recent judicial reform’s passage, leading to partial work scenarios and protests against the changes.

Critics argue that the reforms could lead to an over-centralization of power and undermine the independence of the judiciary. The legal community continues to monitor these developments closely to ensure that any shifts in the judicial landscape do not impede justice and fairness for the citizens of Baja California.
