**Man Narrowly Escapes Death After Truck Runs Out of Fuel on Tijuana-Mexicali Highway**

On the evening of October 31, 2024, 75-year-old José Francisco Pedrote Malfavón had a brush with death when his Fiat collided with a stationary SuKarne truck on the Tijuana-Mexicali highway. The incident left him seriously injured and resulted in the amputation of one of his legs after surgery at Clinic 30 of the IMSS. Unfortunately, his 2018 vehicle was deemed a total loss, complicating matters with his insurance coverage and leaving the car impounded.

During an interview, Pedrote recounted driving towards Mexicali around 8 PM when his vehicle crashed into the unlit SuKarne truck parked in the left lane near the company’s location, and surprisingly, no warning signs were present. Official reports indicate that the accident occurred as Pedrote attempted to overtake vehicles on the left side but failed to notice the 2013 truck. The truck’s driver, identified as Jesús, claimed that the vehicle had stopped after running out of fuel and had no license plates.

Despite the section of the road being under the jurisdiction of the National Guard, local traffic police from Mexicali responded to the accident. A municipal expert blamed Pedrote for the crash, citing “lack of precaution and failure to maintain a safe distance.” However, Pedrote contests this decision as unjust and misleading.

According to Article 97 of the Mexicali Traffic Regulations, larger vehicles such as buses or freight trucks should occupy the rightmost lane, barring certain situations like breakdowns or traffic accidents. This rule violation would typically incur a fine ranging from 108.57 to 542.85 pesos.

Rafael Cervantes Sánchez, the regional prosecutor in Mexicali, mentioned on November 18 that the case awaits a comprehensive report from the prosecutor’s office, which will examine all aspects of the accident, including road conditions, lighting, and vehicle speeds. In some instances, a reconstruction is conducted for an accurate understanding of events.
