### Sala Superior Dismisses SF Appeal; Joel Blas Excluded from Mexicali Council

As we approach the electoral deadline of September 30th, the Sala Superior has reconfigured the composition of the Mexicali City Council, decisively ending the PVEM’s hopes of annulling San Felipe’s election.

On Sunday, September 29, the Sala Superior held a session where magistrates determined the final appeals of the 2024 electoral process. The primary concerns for Baja California were the PRI’s appeal and the San Felipe City Council’s election results.

Overall, the Sala Superior modified the composition of Mexicali’s City Council by restructuring the distribution of council members to favor gender parity in favor of women.

Joel Abraham Blas Ramos, initially placed in the top spot on the PRI’s list of council members by the Electoral Institute of Baja California (IEE), was removed in favor of gender parity. With the council comprising an odd number of members, absolute parity wasn’t feasible, resulting in a distribution of 9 men and 8 women, including 7 members designated by proportional representation—4 men and 3 women.

The Sala Superior dismissed arguments from the IEE, the local tribunal, and the Guadalajara Chamber, stating they neglected criteria set by the highest national tribunal.

According to federal magistrates, the 2021 elections resulted in a gender distribution of 9 men and 8 women. Therefore, the Superior’s criteria suggested an inverted distribution for this electoral process. Since the PRI had the lowest percentage of votes and had placed a man in the first position, this list was revised.

In a last-minute decision, the Sala Superior replaced Joel Blas with Lucina Sánchez González, the second name on the list. The ruling was decided with 3 votes in favor and 2 against.

In the same session, the magistrates dismissed the PVEM candidate Adriana López Quintero’s final attempt to annul the San Felipe election, which saw José Luis Dagnino from Morena elected. The local tribunal’s earlier annulment of the election was overturned by the Guadalajara Chamber, giving the victory to Dagnino López.

The Sala Superior didn’t delve into the case’s merits and deemed the petition for a tribunal review inadmissible. The appeal was dismissed without further consideration.

In the latest electoral updates, the efforts by the Green Party candidate Adriana López Quintero to overturn the San Felipe election results have met their end. The Superior Chamber’s decision confirmed José Luis Dagnino from Morena as the victor.

Magistrates of the Guadalajara Chamber had previously reversed the local tribunal’s decision to annul the election, solidifying Dagnino López’s win. Federal magistrates decided not to review the merits of the case, finalizing this chapter of the electoral process without additional scrutiny.

Thus, the San Felipe constituency remains represented by Morena’s elected candidate, bringing an end to the lengthy debate over the election’s validity.
