### Jaime Bonilla Appears Before FGE Mexicali Over Next Energy Contract

Former Baja California Governor Jaime Bonilla Valdez attended his citation at the Unit of Investigation of Crimes Against Property in Mexicali regarding the Next Energy photovoltaic plant project.

Juan José Pon Méndez, the legal advisor to the state government, confirmed that Bonilla was summoned on Wednesday, September 11, at 2:00 PM after submitting a document to the State Attorney General’s Office (FGE) providing an address for receiving notifications.

Pon Méndez stated, “The purpose is to verify that this document was indeed presented by Mr. Jaime and to provide him with all the elements necessary for him to exercise his right to defense.”

Baja California Governor Marina del Pilar Ávila Olmeda recalled that Bonilla’s administration had contracted Next Energy to construct a photovoltaic plant without federal government authorization. “The federal government is the only authority empowered to approve such developments… Nonetheless, he signed a contract binding federal participations even if the photovoltaic plant is not built,” explained the governor.

Pon Méndez added that nine individuals have been linked to this investigation, with eight of them facing trial opening orders. Among them, five are former public officials, and three are private individuals. These individuals are charged with offenses including the illicit use of powers and functions by individuals and embezzlement.

“In July, through an appeal, we managed to have these individuals also charged with abuse of authority,” highlighted Pon Méndez. The legal advisor mentioned that the penalty for abuse of authority is nine years in prison, the illicit use of powers and functions up to 12 years, while embezzlement can lead to up to 16 years of imprisonment.
