AMLO May Summon Ex President Peña

President López Obrador hints at ex-President Peña Nieto potentially facing questioning by FGR over the Ayotzinapa case. International calls for deeper probe and judicial reforms gain momentum.

### Former President Peña Nieto Could Be Summoned by FGR: AMLO Reveals

President Andrés Manuel López Obrador announced on August 26, 2024, that the Attorney General’s Office (FGR) might call former President Enrique Peña Nieto to testify regarding his alleged involvement in the creation of the so-called “historical truth” in the case of the 43 missing students of the Ayotzinapa Rural Teachers’ College, which occurred on September 26, 2014.

During a morning press conference held at the Treasury Hall of the National Palace, López Obrador remarked that the former president could be summoned by the relevant authorities. However, he emphasized that the final decision rests with the FGR, headed by Alejandro Gertz Manero.

According to a report submitted to the parents of the missing students by the Ayotzinapa Case Truth and Justice Commission (COVAJ), Peña Nieto led meetings where it was decided to perpetuate the narrative that the students were taken to a garbage dump in Cocula, Guerrero, where they were allegedly murdered and burned by state police in collusion with criminal organizations.

On the same day, a report by a digital news outlet revealed that Tomás Zerón de Lucio, former head of the now-defunct Criminal Investigation Agency (AIC), responded to a set of 70 questions by Alejandro de Jesús Encinas Rodríguez, then the head of the Sub-Secretariat for Human Rights, Population, and Migration of the Ministry of the Interior (SEGOB) and president of the COVAJ. Zerón indicated that Peña Nieto had instructed officials to construct this “historical truth.”

López Obrador responded to inquiries concerning the inaction against Peña Nieto by stating that Jesús Murillo Karam, who served as Attorney General from December 4, 2012, to February 27, 2015, during Peña Nieto’s presidency, took full responsibility for the “historical truth.” López Obrador mentioned that Murillo Karam had confessed to being solely responsible, which led to his prosecution and conditional freedom granted by a judge.

“If the FGR deems it appropriate, there are grounds to summon former President Peña Nieto, but this decision lies with the FGR,” López Obrador noted, expressing skepticism over Zerón’s motives for implicating Peña Nieto now. He emphasized the importance of Zerón presenting himself voluntarily to provided recorded statements, as he is allegedly linked to coordinating torture tactics.

López Obrador further underscored that the highest-ranking official prosecuted was Murillo Karam, charged with tampering with evidence and obstructing the investigation into the missing students. Murillo Karam had announced the “historical truth” on January 27, 2015, proclaiming that the students were executed and burned at a trash site in Cocula by the criminal group Guerreros Unidos.

The evidence for this narrative included 487 forensic reports, 156 ministerial inspections, 386 statements, and 39 confessions, among other things. This narrative was heavily criticized and contested over the years, leading to continued calls for justice and transparency.
